Court of Common Pleas Court Fees



All filing fees shall be non-refundable and shall cover all costs, except sheriff's service, which shall be paid separately by the moving party to the sheriff.

Civil Filing Fees

Civil Complaint $ 85.00**
Petition for Name Change $ 85.00**
Justice of the Peace Court Appeal $135.00**
For Appeals from the Department of Public Safety and Dog Control Panel

Subpoena for Sheriff $ 10.00

Wage Attachment, Writs of Levy upon Goods and Chattels and Writs of Sale of Levied Assets, Writ of Replevin $ 20.00

Transfer of Judgment to Superior Court $ 20.00
Petition to Restore Driving Privileges $ 25.00
Court Security Assessment $ 10.00 on each initial filing
Petition for Title to Abandoned Property $ 75.00
Credit Card Chargebacks $ 30.00 per transaction
   *This fee applies to bad checks presented to the Court and is consistent with the intent of 11 Del. C. § 4206(i), which provides for a $30 fee upon conviction of a charge of presenting a worthless check, or a fee of $50 if more than one (1) check by the same person was processed.
   **This fee includes the $10.00 Court Security Assessmet.

   *The Superior Court charges an additional fee of $80.00 per defendant.
