This week, the DPA recorded 12 ⚖ enforcement-related actions. Here are the highlights: #Spain The National Markets and Competition Commission closed the investigation into Amazon, Booking and TripAdvisor over alleged acts of unfair competition. #Italy The Data Protection Authority (Garante) launched an inquiry into the collection of personal data online to train artificial intelligence algorithms. #UnitedStatesofAmerica The Federal Trade Commission opened a public consultation on a consent order and decision against Tel*Link, and two subsidiaries concerning a data breach. #UnitedKingdom The Information Commissioner's Office issued an order following an investigation of the websites' compliance with fair choice regulations regarding personalised advertising tracking opt-outs. #EuropeanUnion The European Commission announced that it had conducted unannounced inspections at companies in two Member States involved in online food, groceries, and consumer goods ordering and delivery. #Canada The  Competition Bureau reached a settlement agreement with TicketNetwork over misleading advertising practices in its online ticket resale business. #Russia The Federal Antimonopoly Service opened an investigation into Yandex over alleged violations of Advertising Law.   Find more enforcement developments in our threads: 📜 Competition enforcement in the digital economy (https://lnkd.in/dCDz4hMW) 📜Consumer protection in the digital economy (https://lnkd.in/dMqwc5wt) 

Pleased to help shed light on recent dark patterns developments. Some key takeaways and additional insights are as follows: - the slew of investigations and proceedings reflects the status of both digital platforms and online advertising and marketing practices as continuing ACCC compliance and enforcement priorities; - dark patterns are squarely in the frame in the context of the ongoing Treasury consultation regarding unfair trading practices, with the Government having agreed in principle to the introduction of an economy-wide prohibition, although the ACCC is certainly not waiting on legislative reform before taking action; - this is consistent with global trends, including the FTC proceedings against Amazon for making it easy to subscribe to but difficult to unsubscribe from Amazon Prime; and - while the above cases relate primarily to consumer protection, dark patterns may also have competition law implications, as demonstrated by the antitrust proceedings brought by the DoJ against Google for payments made to make Google Search the default search engine. #competitionlaw #consumerlaw #darkpatterns #digitalplatforms
