The British Council has been found vicariously liable for the actions of a senior leader who sexually harassed and stalked a worker. The Judge found its internal investigation to be “deeply flawed” after the worker was “erroneously and inappropriately” blamed for “encouraging” the behaviour. Our Partner and Head of Employment and Pensions Nicholas Campbell commented: “The #MeToo movement has had a powerful and positive impact on the willingness of people to speak up on sexual harassment in the workplace in recent years. Notably, though, this case also speaks to the developing trend of digital harassment in the age of remote working during and since the pandemic. For employers looking to protect their employees and the interests of their organisation, a clear policy concerning sexual harassment should be a priority. The Equality and Human Rights Commission’s guidance for employers on sexual harassment, and the law, contain details of what an anti-harassment policy should cover. Employers should also be taking active steps to implement their policy, including through training and communication, and enforcing expected behaviours.” ➡ Read the full details of the case: https://lnkd.in/ez-bpHNV ➡ Our employment law expertise: https://lnkd.in/dmAaz2X

Last week, our recruitment law and workforce solutions specialists met with leaders from the recruitment sector and wider gig economy to discuss what the new Government's planned changes — from a ban on exploitative zero-hour contracts to protection from dismissal from day-one — will mean in practice. Here, Simon Whitehead and Hannah Morrison share the sector’s initial response and explore the potential challenges that might lay ahead. ➡ Read the article: https://lnkd.in/efYRUfTC

🏃♂️☀ With the Paris 2024 Olympics set to kick off this Friday, here’s a clip from our recent interview with double Olympic champion Alistair Brownlee MBE, where he explains his involvement in the International Olympic Committee around athlete welfare in extreme weather conditions. “Looking at Paris 2024, we’re taking this very seriously. A lot of the endurance events are scheduled for early morning or later in the day to avoid any issues with heat. There’s also lots of room for mitigation if there’s the potential for extreme conditions.” This is a great example of the athlete’s voice influencing decisions around athlete welfare.   🎥 Read more and watch the full interview: https://lnkd.in/edDwyumZ ➡ Discover our sports law expertise: https://lnkd.in/dewf5GqH

Chief Executive Officer at Brabners | Certified B Corp | Driving Positive Change at the UK's Leading Independent Law Firm

Building on the theme of a recent LinkedIn post highlighting that "everything will change and nothing will change, until..."   It is encouraging to see that a reset of #devolution has been made a priority by the new Government. In our view, a key part of this reset has to be a greater recognition of the role that purpose-led businesses and civil society can play in driving regional policy, in collaborative partnership with the public sector. That is one of the key pillars of the #TrueNorthNetwork, a new network of more than 270 – and growing – like-minded businesses, leaders and other organisations, committed to supporting the future of the North through economic growth and social prosperity. So, together with Prof. Maggie O' Carroll & Michael Hayman MBE DL - and on behalf of the True North Network - I have written to the cohort of Northern MPs that form a significant part of the new Government and the directly elected mayors of the North, to offer our help and support as they draw up their local economic and growth plans, and identify the sectors and necessary infrastructure we need to thrive.   I also spoke with Maggie for the latest insights piece on our #TrueNorth hub, which explores what a new model of devolution could look like – what it should include, what it perhaps shouldn’t, and what models we can look to for inspiration from outside of the UK.   Read the full piece here and please engage with us and let us know if you agree that a reset of the relationship between Westminster and the regions should also consider a reset of what we mean by devolution itself: ➡ Read the article: https://lnkd.in/eP2ettzZ

Following the General Election, the new Government has stated that a reset and expansion of devolution is a policy priority. It's an exciting opportunity for the North, but our CEO Robert White says that it is one that requires further consideration of what devolution is for and who ought to have a role in regional decision-making. Read our latest insights for True North here, including: 🔹 Robert’s conversation with True North co-chair Prof. Maggie O' Carroll, CEO — The Women's Organisation, on what devolution should include, what it shouldn’t and where we can look to for inspiration. 🔹 Why regional policy hasn’t worked and how we get it moving. 🔹 How True North and its members from the private sector and civil society can support the public sector in driving forward economic growth and prosperity in the region. ➡ Read the article: https://lnkd.in/eP2ettzZ
