USCIS announced last week that August 19 will be the starting date to file applications. However, to date, USCIS has not published any information about the filing forms, fees, or processes.     Parole-In-Place (PIP) Update Starting date for applications: August 19, 2024 USCIS updated its information about the new Parole-in-Place process for certain family members who are married to U.S. citizen spouses and are seeking a green card inside the U.S. USCIS stated that eligible applicants may file their applications starting on August 19, 2024. ❗However, there is NO application form or filing process yet. USCIS will be releasing additional information about the forms, fees, and filing process soon. Do not submit any paperwork now or it will be rejected. Also, USCIS provided information about the supporting documents that applicants must present with their applications. Additional information can be found on the USCIS website. 👀For now, avoid scams and service providers that are falsely saying you can file your application now. ⚖If you have questions, consult with an immigration lawyer or authorized legal representative. 🔔We’ll be providing additional information as it becomes available.     👨💻What if you were not officially married to a U.S. citizen on or before June 17, 2024? Will you still qualify for the new “parole-in-place” program? 📜 The good news is that you might still qualify if you are common law married. A common law marriage is a legally recognized marital relationship without having an official marriage license. USCIS generally treats these common law marriages as the same as official marriages. But it will depend largely on whether the state where you live recognizes common law marriages and whether you meet those requirements under state law. 👉It is important to consult with a lawyer to determine if you are common law married, and determine what the pros and cons are for claiming a common law marriage. 🖥Tune in to our shows to learn more about immigration and citizenship benefits.     What we know so far about the permanent bar as it relates to the new #PIP parole-in-place? Not much. But our clients have been asking, and so here are some of our thoughts about it. Will it apply? In short, probably yeah. But we should wait and see for the final instructions from USCIS (sometime in the summer). 📜The “permanent bar” is a crucial aspect of U.S. immigration law. It prevents many individuals from immigrating due to their unlawful entry history, even if they have family members who are U.S. citizens. With a few exceptions, the permanent bar applies generally to individuals who were unlawfully present in the U.S. for more than year, then departed the U.S. and attempted to reenter without proper authorization. Of course, this is a simplified description of the rule and there might be some exceptions or arguments you could make to avoid this bar. It is important to consult with an immigration lawyer to know for sure. Although we think the “permanent bar” may disqualify someone from applying under the new parole-in-parole process, it is important to wait for final instructions and guidance from USCIS, which we expect sometime this summer.
