    The Federal Emergency Management Agency (FEMA) released a notice of proposed rulemaking (NPRM) to regulations for the Public Assistance program last week. These highly anticipated revisions include adding eligible Private Nonprofit facilities, expanding categories of eligible assistance, and placing Indian Tribal governments on par with States and Territories as recipients of program funding. Comments on the NRPM are due September 3, 2024, with FEMA’s final rule expected in late Fall 2024.     On June 6, 2024, the U.S. Supreme Court clarified the federal government’s funding responsibilities under the Indian Self-Determination and Education Assistance Act (ISDEAA) of 1975. The Court’s landmark decision mandates more expansive reimbursement for administrative costs faced by tribal health care programs, significantly enhancing their financial stability. This ensures that Tribes and Tribal Organizations will receive essential funding to cover health care program expenses.
