The Doctors Company was proud to be named a finalist for Claims Team of the Year at the Business Insurance 2024 U.S. Insurance Awards in New York on July 18. These awards recognize exceptional work by commercial insurance and risk management professionals across the industry. We were honored for the data-driven insights in our study “Diagnosis-Related Medical Malpractice Claims With Indemnities Over $1 Million: Understanding the Primary Drivers,” which examines the contributing factors behind high-indemnity claims. In recent years, most states have reported medical malpractice verdicts greater than $10 million, and high verdicts are an industry-wide concern that can lead to higher healthcare costs and decreased patient care access. This analysis of rising verdicts provides healthcare leaders with strategies to help mitigate risk and improve care, part our mission to advance, protect, and reward the practice of good medicine. Workplace violence in ambulatory care settings has become increasingly prevalent. Chronic and complex health conditions are treated more frequently in outpatient settings, increasing the likelihood that patients and families may become frustrated. Many healthcare workers are not trained to safely respond to these behaviors and security resources might not be available, creating a vulnerable environment for healthcare workers. In this one-hour complimentary webinar hosted by the California Medical Association and sponsored by The Doctors Company, attendees will learn strategies for developing a formal workplace violence prevention plan, in accordance with California Senate Bill 553 (2023). From 2013 to 2023, the American court system saw a roughly 67% increase in the number of medical malpractice verdicts awarding $10 million or more. While these skyrocketing dollar amounts give the idea that the pace of medical malpractice litigation is up, the opposite is true: Claim frequency is flat or decreasing nationwide. In the latest edition of “The Trust Factor,” a weekly newsletter from Fortune, Business and Finance Editor Nick Rockel shares insights from Robert White, President of The Doctors Company and TDC Group, on how social inflation affects verdicts and increases the cost of healthcare. Medical malpractice verdicts over $10 million have surged by 67% from 2013 to 2023, with over half of those verdicts exceeding $25 million in 2023 alone. Despite fewer claims overall, "social inflation" is driving increases in verdict amounts, fueled by societal desensitization to large numbers, third-party litigation investors, and emotional jury manipulation. This trend raises healthcare costs and promotes defensive medicine, but fortunately, tort reform may offer a solution.
