It is truly awe inspiring and a time for reflection for attorneys to appear in this extraordinary building. I will always fondly remember trying cases to juries here on the same floors where lawyers have trod since 1796.
Bill Mecca NJ Courts videographer, the late Joe Laufer Burlington County Historian and I did a great video history on the Olde Courthouse. Miss giving tours of this prime example of Federalist architecture.
High Court delivers win for Marks and Spencer!
The High Court has today handed down judgment allowing M&S to demolish its Oxford Street store. The court was damning in its assessment of the Government (who tried to stop demolishment plans) by stating that they had made several errors when coming to their decision, including misunderstanding planning policy! Not a good 24 hours for Michael Gove.
The decision is a big win for M&S and certainly will bring some rejuvenation to Oxford Street if plans move forward but I am sure this is not the end of the matter. What do you think? Comment below 👇

A centralized jury seated under the judge’s bench routinely characterized traditional Virginia courtrooms in the 18th century. Thomas Jefferson was among the champions of this arrangement (called the Virginia Revival Model), which Judge Robert J. Conrad Jr. and Justine Parry Welch wrote about in Judicature.
“For Jefferson, architecture was yet another form of Enlightenment rhetoric. […] Jefferson portrayed through architecture ‘humanity’s right of self-governance.’ What better way to solidify this pillar of American democracy than to incorporate architecturally and visually the jury’s shared authority with the magistrate judges? Virginians embraced this concept, and, one after another, county commissioners implemented Jefferson’s model when building new courthouses,” they wrote.
When the Charles R. Jonas Federal Courthouse in Charlotte, North Carolina was undergoing renovations from 2019-2021, the architects and designers had the opportunity to reimagine a Virginia Revival Model Courtroom in the 21st century.

Detached Garage with Annex Planning Appeal- Telford Wrekin Council.
This planning application was originally validated by Telford and Wrekin Council on the 16th June and refused on the 16th August for a Detached garage with Ancillary Accommodation Above.
The refusal reasons given by Telford and Wrekin Council were that The Local Planning Authority considered that;
The scale of the proposed unit of accommodation is disproportionate to the application dwelling, by virtue of its overall footprint and ridge height.
Combining the overall scale of the outbuilding and the nature of the application site, which is long and narrow, the proposal would have a cramped and contrived appearance on the application site; failing to respect or respond positively to its context.
Given the positioning of the outbuilding to the north of the site with a separation distance of approximately 23 metres from the rear elevation of the application dwelling, the outbuilding is not considered to result in an addition that is incidental to the enjoyment of the main dwelling.
Furthermore, the proposed outbuilding will be extremely prominent within the surrounding area and by virtue of its overall scale, would result in an incongruous form of development, which is not in keeping with the character or appearance of the surrounding area.
Clearly from that refusal Telford and Wrekin Council did not want this granted.
Many people upon receiving a refusal like this, decide to give up at this stage, and do not go to appeal, but honestly refusal reasons like these are perfectly normal and although comprehensive can be overcome, as we show in this video.
Providing a comprehensive and robust argument, bringing national and local policies into play, and detailed reasoning as to why the findings were wrong, and in-fact this development was perfectly acceptable.
Additionally we completed a detailed amount of research to find very similar cases, that the planning inspectorate had previously granted, and we looked to use these cases to support our argument as best possible.
The inspector visited the appeal site on 8th February and issued the appeal decision on 25th February in a concise three page appeal decision report.
The good news was that the appeal was upheld and the permission granted.
As an organisation HEAL Planning is one of the leading appeals specialists with both dedicated in-house planning and legal teams, whose job it is to win your case, both these skill sets are invaluable to produce a robust and compelling case to gain a win.
You won’t find many organisations in our industry that have both of these skill sets a planning and a legal team, and it is most definitely a major reason why we have the success rate we do.
Without appealing your Planning refusal you cannot gain the permission you would like!

What are the specific legal responsibilities and liabilities of condo board members? How can boards effectively communicate important decisions and updates to homeowners and residents? Are there specific legal considerations property managers should be aware of when advising the board on conflict resolution and handling difficult board members, homeowners, residents?
Last month Erin Berney and John Gilbert held a complimentary Q+A session that addressed attendee questions about board member duties and how to best deal with dysfunction.
