As the utilization of AI expands, its impact on the practice of patent law is escalating daily. Director Kathi Vidal of the U.S. Patent and Trademark Office recently addressed the issue of attorney conduct, particularly concerning the use of artificial intelligence (AI) tools. In a memorandum released on Tuesday, Vidal assured that the existing mechanisms within the agency are sufficient to address both proper and improper use of AI. However, she also pledged to offer further guidance in the coming months and emphasized the importance of clarifying how current regulations, including the rules of professional conduct, apply to practitioners utilizing AI tools. While acknowledging the potential benefits of AI, such as increased access and reduced costs, she underscored the need for vigilance against misuse. Citing concerns raised in the Supreme Court's 2023 year-end report on the federal judiciary, Vidal highlighted instances of AI misconduct in federal courts, including attorneys citing nonexistent cases (such as a recent case in the Second Circuit where a New York attorney faced repercussions for submitting a brief containing a fake case generated by an AI tool). Despite the involvement of AI, Vidal emphasized that attorneys remain responsible for ensuring the accuracy of their submissions. The existing USPTO rules mandate that attorneys thoroughly review and certify the accuracy of their filings, irrespective of AI assistance. Vidal stressed that reliance solely on AI's accuracy without proper verification is insufficient. Furthermore, Vidal reminded practitioners that the USPTO retains the authority to sanction those who submit filings containing inaccuracies, whether intentional or not. Possible sanctions include terminating proceedings or initiating disciplinary actions against the practitioners involved. Among other things, the paper emphasizes on: 1. The practitioner's duty to 𝐞𝐱𝐞𝐫𝐜𝐢𝐬𝐞 𝐜𝐚𝐧𝐝𝐨𝐫 𝐚𝐧𝐝 𝐠𝐨𝐨𝐝 𝐟𝐚𝐢𝐭𝐡 when using AI tools. 2. Duty to 𝐯𝐞𝐫𝐢𝐟𝐲 𝐭𝐡𝐞 𝐚𝐜𝐜𝐮𝐫𝐚𝐜𝐲 𝐨𝐟 𝐀𝐈-𝐠𝐞𝐧𝐞𝐫𝐚𝐭𝐞𝐝 𝐜𝐨𝐧𝐭𝐞𝐧𝐭 before submitting it to the USPTO, ensuring all legal arguments, facts, and citations are correct and substantiated. 3. Duty of 𝐦𝐚𝐢𝐧𝐭𝐚𝐢𝐧𝐢𝐧𝐠 𝐭𝐡𝐞 𝐜𝐨𝐧𝐟𝐢𝐝𝐞𝐧𝐭𝐢𝐚𝐥𝐢𝐭𝐲 𝐚𝐧𝐝 𝐢𝐧𝐭𝐞𝐠𝐫𝐢𝐭𝐲 of sensitive client information. 4. Duty to 𝐩𝐫𝐞𝐯𝐞𝐧𝐭 𝐦𝐢𝐬𝐮𝐬𝐞 𝐚𝐧𝐝 𝐦𝐢𝐭𝐢𝐠𝐚𝐭𝐞 𝐫𝐢𝐬𝐤𝐬 𝐚𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐞𝐝 𝐰𝐢𝐭𝐡 𝐀𝐈 technology, by implementing technical safeguards, such as preventing unauthorized data sharing or generating inaccurate legal documents. The guidance encourages legal professionals to stay informed about new AI technologies and their potential impacts on legal practices. In return, the USPTO has declared it willingness to promote training that helps integrate AI tools responsibly into workflows, ensuring a balance between innovation and adherence to professional standards. In only a year, #AI has reshaped the business of law. And it has only just gotten started. Yes, it has taken work that once required hundreds of man hours and reduced it to mere minutes. But that is not the biggest effect. This change is allowing more lawyers to engage more proactively with clients and targets. Pitches will increasingly rely on a law firm’s client data that can help predict challenges and outcomes. Transactional lawyers, for example, will be able to tell prospects not just how many similar deals they’ve done, but also how long the deals will take to close, the likelihood of regulatory challenges and which clauses will require the most negotiation. We’ll also see law firms integrate their proprietary data with third-party data on industry trends to propose new opportunities to clients. On the litigation side, we’ve already seen lawyers leveraging firm data to bring insights to clients about judges, venues and motion practice. And these are only some of the new ways in which lawyers will interact with their clients. More will come as #AI unveils new and different data that can be interpreted to the good of the clients. #AI #clientservices
